Who is liable when dogs are off the lead? (Scotland)

The recent judgement of Inner House of the Court of Session in Scotland (Court of Appeal equivalent) in the case of Welsh v Brady offers guidance on the thorny issue of the liability of owners for the actions of their animals.    The position in Scotland regarding injuries caused by dogs is quite clear cut - if the injury is caused by biting and the like then the keeper is liable. However, if the injury was caused any other way, then the keeper is only liable if the breed of dog is likely to be a danger.

The Court of Appeal in England has recently reached a decision in a very similar case.
